Who decides where holiday rentals are allowed in the Canary Islands?
Local councils (Ayuntamientos) will soon decide which areas are suitable for holiday rentals. The goal is to prevent over-tourism in busy zones and keep enough long-term housing for residents. These zones have not been defined yet, so watch for updates from your local council.
- Prevents over-tourism in high-density zones.
- Protects long-term housing for local residents.
Will new buildings be allowed to offer holiday rentals?
New construction will face stricter limits. A maximum of 10% of new buildings may be used for holiday rentals. It is still unclear whether this will require a specific permit or be linked to the 10-year minimum building age rule.
- Stricter restrictions will apply to "Green Islands," but the islands in this category have not been confirmed.
Do I need approval before opening a new holiday rental?
Yes. All new holiday rental properties will need approval from the relevant Island Cabildo before they can operate. Properties must also be ready to comply with upcoming inspection plans.
Can I list a holiday rental in a protected area?
No. Properties in national parks, nature reserves, and areas of high environmental value will not be eligible for holiday rental use. Existing holiday rentals in these areas will not be affected by the new prohibition.
What quality and sustainability standards will holiday rentals need to meet?
New standards are expected to raise the quality and environmental responsibility of holiday rentals. The final list is still pending approval, but the following requirements are expected.
- A minimum surface area of 35 m².
- Accessibility for people with reduced mobility. This requirement is still being defined and may involve complex modifications.
What happens to my existing holiday rental license?
If you already run a holiday rental, you can continue doing so indefinitely. However, your license cannot be transferred if you sell the property, because it belongs to you and not the property.
- Property managers may continue managing existing rentals for 5 years, or up to 10 years if they comply with the new regulations. This point is still under discussion.
What will I need to open a new holiday rental?
If you plan to open a new holiday rental, you will need municipal authorisation from your local council (Ayuntamiento). The building must also meet the rules below, which are still being finalised.
- A minimum building age of 10 years, which is under discussion.
- Full compliance with new safety, health, and environmental regulations.
- A location outside protected or restricted areas.
