Spain's Real Decreto 933/2021 requires hosts to register every guest staying in their property. This guide explains what the law means for you, which data you need to collect, and how the Holidu online check-in feature helps you submit guest registration data on time and in full.

What is Real Decreto 933/2021?

Real Decreto 933/2021 is a Spanish regulation that strengthens public security and helps prevent criminal activity in the holiday rental and car rental sectors. Under this decree, hosts and intermediary platforms such as Holidu must collect and report details about guests, properties, and bookings to the Spanish Ministry of the Interior.

When did the law come into force?

The law came into effect on January 2, 2023, with a transition period that ended on October 1, 2024. Since then, failing to comply or submitting incomplete or late information can result in fines. The penalty depends on how serious the infraction is:

  • Minor: €100 to €600
  • Serious: €601 to €30,000
  • Very serious: €30,001 to €200,000

How does this law affect hosts?

If you rent out a property in Spain, you are responsible for reporting guest registration data within 24 hours after each guest checks in. This applies to every property located in Spain, whether you live in Spain or abroad, and whatever your nationality.

  • You must report data to the SES Hospedajes platform run by the Spanish Ministry of the Interior.
  • If your property is in Catalonia, continue reporting to the Mossos d'Esquadra. If it is in the Basque Country, report to the Ertzaintza.
  • You must make sure all mandatory guest details are complete and accurate, even when Holidu reports them for you.

What information must you report?

The law requires four categories of data: host details, property details, guest information for every person in the booking, and booking or transaction details. Holidu automatically collects the booking and transaction data. You are responsible for collecting the following guest information:

  • Full names
  • Date of birth
  • Residential address
  • Contact details (phone number or email)
  • ID type and number for adult guests
  • Support ID number for guests with a Spanish ID (NIF or NIE)
  • Relationship to any minors travelling with them, where applicable

Guests can provide this information through the online check-in form that Holidu emails to them. The form is also accessible in the booking details in your Holidu account.

How does Holidu help you comply?

Holidu is an intermediary platform, so we collect and securely store the booking and transaction data needed for reporting. Holidu reports this booking information to SES Hospedajes within 24 hours after a booking becomes non-refundable. If a non-refundable booking is later cancelled, Holidu updates SES Hospedajes to cancel or withdraw the reported information.

The online check-in feature is the main tool for collecting guest details. Once you set it up, guests complete their information before arrival, and Holidu sends the data to the relevant authority automatically. This saves time and reduces the risk of missing details.

How do you submit guest data through Holidu?

Follow these steps once to set up automatic reporting:

  1. Register on the SES Hospedajes platform through the official Ministry of the Interior website.
  2. Select "Hospedajes y alquiler de vehículos" and find the "Access to the register of HOSPEDAJES establishments and entities".
  3. During registration, select "Send communications via webservice".
  4. In your Holidu account, activate the Guest Online Check-in feature and choose your relevant authority: SES Hospedajes, Mossos d'Esquadra, or Ertzaintza.
  5. Enter your login details for SES Hospedajes or the applicable regional authority.

After setup, Holidu sends guest details to the authorities by 11:00 PM on the check-in day. Check each booking to confirm that guest information is complete. If anything is missing, collect it directly from your guests when they arrive.

To make sure everything is working, confirm that you selected SES Hospedajes (or the correct regional authority), entered the right credentials, and ticked "Send communications via webservice" on the SES Hospedajes platform. You can read more in our guest check-in feature FAQs.

Frequently asked questions

Can I see a list of the bookings Holidu has reported?

There is no direct list of reported bookings. To check, review your confirmed and non-refundable bookings in your Holidu account. Cancelled bookings have their data withdrawn from SES Hospedajes.

Why does Holidu have to report this data?

The law requires intermediary platforms to report this data so that authorities can monitor accommodation use. This improves security for residents and visitors.

Does this apply if I do not live in Spain?

Yes. The regulation applies to every property located in Spain, regardless of where the host lives or what nationality they hold.

Do I still need to check guest details if Holidu reports them?

Yes. You are responsible for making sure all mandatory guest details are collected and accurate. If any information is missing, ask your guests for it at check-in.

What happens if I do not comply?

Failing to comply, or submitting incomplete or late information, can lead to fines. Minor infractions cost €100 to €600, serious infractions cost €601 to €30,000, and very serious infractions cost €30,001 to €200,000.
